The Chair has considered the submissions that were made by counsel (Mr Powlesland and Ms Nevin) at the Pre Inquiry Meeting on 7th February to the effect that the PLA is calling no witness to specifically address environmental matters. It is now proposed that the PLA’s Director of Sustainability, Grace Rawnsley, will attend the Inquiry on 10th March 2025 to answer questions from the Chair and from objectors on any relevant environmental factual matters that Mr Stride and Mr Trimmer do not cover in their evidence or which those witnesses are unable to answer when they give evidence.
The Chair is aware of the position taken by Mr Turney KC and of the submissions on this issue put forward by counsel for the objectors at the hearing on 7th February. It will be necessary for the Chair to hear submissions prior to 10th March from all counsel (and by any objectors who wish to raise points that counsel do not address) for the purpose of ruling on the scope of the questions that will be put to Ms Rawnsley on behalf of objectors. The Chair will consider inter alia whether proposed issues for questioning are relevant to the HRO and whether some of the proposed matters are points that should form the basis of legal argument, rather than questioning of a witness.
Ms Rawnsley will appear on the revised timetable as a provisional witness because there is a possibility that the matters upon which she might be able to assist will have been covered in the evidence of Mr Stride and Mr Trimmer, or the other PLA witnesses.
There is no proof of evidence from Ms Rawnsley. The Chair has indicated that the Inquiry will consider the scope of questions to be put to her (if questions are to be put) after the conclusion of Mr Trimmer’s evidence, by which time it is hoped that the factual issues upon which she might be able to assist the Inquiry will have crystallised.
The Chair will deal with this matter in his opening statement on 25th February.
